Disposition notice
The Third District Court of Appeal affirmed the judgment against Ian Michael Almon Robles. Appointed counsel filed a brief under People v. Wende (1979) 25 Cal.3d 436, asking the court to review the record for arguable issues on appeal. Defendant was advised of his right to file a supplemental brief within 30 days, but no communication was received. After examining the entire record, the court found no arguable error that would result in a disposition more favorable to defendant and affirmed the judgment. Pursuant to a negotiated plea agreement with a maximum sentence of two years eight months, defendant pleaded no contest to driving or taking a vehicle without consent (Veh. Code, § 10851, subd. (a) — count one), fleeing a peace officer while driving recklessly (Veh. Code, § 2800.2, subd. (a) — count four), and driving under the influence of a drug (Veh. Code, § 23152, subd. (f) — count five). The trial court denied probation and sentenced defendant to the middle term of two years in prison on count one, a consecutive eight months on count four, and a concurrent 180 days in county jail on count five, awarded 93 days of presentence credit (47 actual and 46 conduct), and ordered a $1,200 restitution fine, a $1,200 parole revocation fine, a $160 court operations assessment, a $120 criminal conviction assessment, and $5,621.20 in victim restitution. Defendant did not request a certificate of probable cause.
