Disposition notice

On November 4, 2026, the U.S. District Court for the Southern District of California granted the United States’ motion to dismiss this False Claims Act qui tam action and to unseal the relators’ complaint. The United States had filed a notice of intervention for the purpose of dismissal on September 28, 2026, and moved under 31 U.S.C. §§ 3730(b)(2), (b)(4)(A), and (c)(2)(A) and Federal Rule of Civil Procedure 41(a). No opposition was filed. Relying on United States ex rel. Polansky v. Executive Health Resources, Inc., 599 U.S. 419 (2023), the court held that Rule 41 standards govern and that dismissal was proper because the government intervened and moved to dismiss before any answer or summary-judgment motion was served. The action was dismissed with prejudice as to the relators and without prejudice as to the United States. The court also ordered the seal lifted from the complaint, all filings to date, the order, and any subsequent filings, and directed the Clerk to close the case.
