Disposition notice

On October 8, 2026, the U.S. District Court for the Central District of California, after the deadline to file objections passed with no objections received, expressly accepted and adopted the findings, conclusions, and recommendations of the United States Magistrate Judge in Juan Sebastian Diaz-Sanchez v. J. Johnson, et al., No. 5:26-cv-02728-RGK-AJR, and ordered judgment entered granting the Petition. No later than October 13, 2026, Respondents must either provide Petitioner Juan Sebastian Diaz-Sanchez with a bond hearing pursuant to the injunction in Rodriguez v. Robbins, 715 F.3d 1127, 1131 (9th Cir. 2013), at which the Government bears the burden of proof by clear and convincing evidence that Petitioner is a danger to the community and/or a flight risk that cannot be mitigated by conditions of release including electronic monitoring, or release Petitioner from custody if the hearing is not timely provided; if Petitioner requests a delay, the hearing may be held beyond the deadline and Respondents must grant any reasonable delay request. Respondents must file a notice of compliance within three days of the bond hearing. The court further ordered the Clerk to serve copies of the Order and Judgment on Petitioner at the current address of record and on all parties who have appeared. The order itself does not restate the magistrate judge's reasoning; it incorporates that reasoning by accepting and adopting the Report and Recommendation.
