Disposition notice

By order signed October 23, 2026 and filed October 26, 2026, the U.S. District Court for the Eastern District of California adopted the parties’ stipulation and awarded plaintiff Diana Lynn Love $10,000 in attorney’s fees under the Equal Access to Justice Act, 28 U.S.C. § 2412(d). The order states that Love filed the action on April 22, 2026 seeking review of a final decision of the Commissioner of Social Security, and that the matter was remanded to the Commissioner for further proceedings on September 28, 2026. The court directed that fees be made payable to plaintiff, but if the Treasury Department determines that plaintiff does not owe a federal debt, the government shall cause payment to be made directly to plaintiff’s counsel, Francesco Benavides. The court further directed that, whether payment is made payable to plaintiff or to counsel, the check shall be mailed to plaintiff’s counsel at Francesco Paulo Benavides, Law Offices of Francesco Benavides, 1990 N. California Blvd., 8th Floor, Walnut Creek, CA 94596.
