Disposition notice

On November 3, 2026, Judge Stanley Blumenfeld, Jr. dismissed Calvin Greene's federal claim with prejudice and his state-law claims without prejudice. The court had previously dismissed the complaint on September 24, 2026, but granted Greene an opportunity to file a first amended complaint by October 21, warning that failure to do so would be construed as an election to stand on the original complaint and result in dismissal. Because Greene did not file an amended complaint, the court found he consented to dismissal, had failed to state a federal claim, and declined to exercise supplemental jurisdiction over the state-law claims. The dismissal was issued under Federal Rule of Civil Procedure 41(b) and the factors in Ferdik v. Bonzelet, 963 F.2d 1258 (9th Cir. 1992). A final judgment was to be issued separately.
