Disposition notice

On November 3, 2026, the U.S. District Court for the Central District of California granted Mohamed Adan Dahir's petition for a writ of habeas corpus under 28 U.S.C. § 2241, citing Cheng v. Warden of Adelanto ICE Processing Center, 2026 WL 2629685 (C.D. Cal. Sept. 7, 2026). The court ordered Dahir released from ICE detention forthwith upon posting bond or on conditional parole no more restrictive than the release conditions previously imposed on or about December 6, 2024, and stated that judgment in his favor would be entered accordingly. The court retained jurisdiction to enforce its order and judgment if Dahir is arrested and re-detained in violation of the Immigration and Nationality Act or the specified release-revocation regulations. It also retained jurisdiction over a successive § 2241 action or petition alleging unlawful immigration custody within the district, while citing the abuse-of-the-writ doctrine concerning claims that were or could have been raised in a prior habeas petition.
