Disposition notice
On October 29, 2026, the California Court of Appeal, Second Appellate District, Division One, affirmed the judgment against Jose Guadalupe Sanchez Lozano in B347710. A jury convicted him of grossly negligent firearm discharge, possession of a controlled substance with a firearm, carrying a loaded unregistered handgun, and misdemeanor methamphetamine possession, with a personal firearm-use finding. The superior court imposed a prison term of three years and eight months, consisting of the middle term of three years for possession of a controlled substance with a firearm, one-third the middle term or eight months for discharge of a firearm, and the middle term of two years for carrying an unregistered handgun, plus 364 days in jail for methamphetamine possession. The court stayed the sentences for carrying an unregistered handgun and methamphetamine possession pursuant to Penal Code section 654. The court found Sanchez was unable to pay fees, imposed but stayed a restitution fine, and granted 801 days custody credit. Appointed appellate counsel filed a brief under People v. Wende raising no issues and requesting independent review. Sanchez did not submit additional contentions after receiving notice and an opportunity to do so. The Court of Appeal concluded that counsel had complied with Wende and that the record presented no arguable issues, and therefore affirmed the judgment.
