Disposition notice

The Fourth District Court of Appeal, Division One, affirmed the San Diego County Superior Court's order denying Lee Quillar's 2024 request to transfer his case to juvenile court under Welfare and Institutions Code section 707.5. Quillar was 17 when charged in 1985, pleaded guilty to grand theft from the person and assault with a deadly weapon, and was sentenced to prison for four years eight months; his 2018 resentencing petition under Penal Code section 1170.18 was granted as to the grand theft count, and he is currently serving an 11-year determinate term plus a consecutive 25-years-to-life indeterminate term from a separate offense with a prior strike. After the trial court denied the 2024 transfer request, appellate counsel filed a People v. Delgadillo brief indicating no arguable issues for reversal. Counsel acknowledged the court was not required to independently review the record in a Delgadillo-governed appeal but urged discretionary review; separately, to assist the court and comply with Anders v. California, counsel identified the possible issue whether the trial court erred in denying retroactive transfer to juvenile court. Quillar was advised he could file his own brief but did not. The court exercised its discretion to review the record, found no arguable issues for reversal, and affirmed the order denying transfer to juvenile court.
