Disposition notice
On October 16, 2026, United States Magistrate Judge Pedro V. Castillo signed a judgment in the U.S. District Court for the Central District of California granting the petition for writ of habeas corpus filed by Jose Manuel Abadin Perez against U.S. Immigration and Customs Enforcement, pursuant to a separate Memorandum Decision and Order Granting Petition and Immediate Release. The judgment orders ICE to immediately release Abadin Perez under reasonable conditions of supervision and permanently enjoins ICE from re-detaining him without first providing constitutionally adequate process and establishing a lawful basis for renewed detention consistent with the Fifth Amendment and Zadvydas v. Davis, 533 U.S. 678 (2001). The court found that the August 24, 2026 Notice of Removal, standing alone, does not provide constitutionally adequate process for removal to Mexico because it does not inform him of the legal basis for the designation, the timing of the proposed removal, or the procedures through which he may seek withholding or CAT protections as to Mexico. ICE is permanently enjoined from removing him to Mexico or another third country not identified in the operative exclusion and deportation order unless and until ICE provides constitutionally adequate notice and a meaningful opportunity to consult counsel and pursue any applicable withholding, CAT, reopening, or other country-specific protection before removal. ICE must file a status report confirming release within two days, any fee motion must be filed within the deadlines set by the Equal Access to Justice Act, 28 U.S.C. § 2412, and the court's Local Rules, and the court retains jurisdiction to adjudicate any such motion or other collateral enforcement issues.
