Disposition notice

The U.S. District Court for the Southern District of California granted Isaias Ros Domingo's petition for a writ of habeas corpus on November 4, 2026. The court ordered respondents to release Domingo by 5 p.m. on November 5, 2026, and to file an affidavit attesting to his release by 5 p.m. the following business day. The court enjoined respondents from redetaining Domingo during his removal proceedings without first providing an individualized bond hearing before a neutral immigration judge, where the government bears the burden of proving by clear and convincing evidence that he is a danger to the community or a flight risk. The court specified that the immigration judge must consider Domingo's financial circumstances and alternative conditions of release, and may not deny bond based on mandatory detention provisions or Board of Immigration Appeals precedent. Respondents must file a declaration attesting to full compliance and are enjoined from redetaining Domingo until 48 hours after filing. The November 12, 2026 hearing was vacated and the case closed. The court stated its reasons were provided at Docket 6.
