Disposition notice
On October 16, 2026, Judge William H. Orrick of the U.S. District Court for the Northern District of California approved a stipulation between the plaintiffs and the County Defendants (County of Mendocino, Sergeant Samuel Logan, Deputy Jesus Lopez, and Sheriff Matt Kendall) and ordered that the Fourth, Fifth, and Sixth Causes of Action in the First Amended Complaint (ECF 41)—the Monell claims for unconstitutional custom, practice, or policy, failure to train, and ratification under 42 U.S.C. § 1983—are dismissed without prejudice as to the County of Mendocino, and that Sheriff Matt Kendall is dismissed from the action without prejudice. The parties are to bear their own attorneys' fees and costs as to the dismissed claims and the dismissed party. The stipulation recited that the County Defendants were similarly situated to the City of Willits defendants, whose Monell claims the court had previously dismissed without prejudice (ECF 51), and that the dismissal does not affect the plaintiffs' remaining claims against the defendants.
