Disposition notice

On October 21, 2026, Judge André Birotte Jr. of the U.S. District Court for the Central District of California denied as moot a habeas corpus petition filed under 28 U.S.C. § 2241 by Set Salvador Esquivel Alvarado, who had challenged his detention at the Adelanto ICE Processing Center under the Fourth and Fifth Amendments. Respondents' answer informed the court that the petitioner had been removed from the United States on September 23, 2026, attaching his I-210 Voluntary Departure and Verification of Departure form. Applying Ninth Circuit and Supreme Court mootness precedent, the court concluded that because the petitioner was no longer subject to immigration detention or any condition from which the court could grant relief, the petition was moot and had to be dismissed for lack of jurisdiction. The court ordered the petition denied as moot and directed the Clerk to enter judgment accordingly.
