Disposition notice

The Court of Appeal, Fourth Appellate District, Division One, affirmed the judgment against Claudell Hatter, who had pleaded no contest to possession of a controlled substance in a prison facility (Pen. Code, § 4573.6, subd. (a)) and was sentenced to the middle term of three years, to be served concurrently with an existing sentence of life without parole. Appellate counsel filed a brief under People v. Wende (1979) 25 Cal.3d 436 and, to assist the court in its review and in compliance with Anders v. California (1967) 386 U.S. 738, identified two possible issues—whether the no contest plea was knowing and voluntary, and whether the court erred in denying Hatter's request to stay the minimum restitution fine. Hatter was advised he could file his own brief but has not attempted to file his own brief. The court independently reviewed the record for error and did not discover any arguable issues for reversal on appeal; competent counsel has represented Hatter in this appeal. The judgment is affirmed.
