Disposition notice

The Second District Court of Appeal, Division Six, affirmed the judgment against Gabriel Barragan. He had pleaded no contest to bringing a controlled substance into a penal institution and admitted a prior strike conviction. The trial court found the plea voluntary, knowing and intelligent and imposed the lower term of two years, doubled to four years. Appointed appellate counsel requested independent review under People v. Wende. On July 8, 2026, the Court of Appeal notified Barragan that he had 30 days to submit grounds, contentions or arguments; none was received. After reviewing the entire record, the court was satisfied that counsel had complied with his responsibilities and no arguable issue existed. The original opinion is authored by Justice Baltodano, with Presiding Justice Cody and Justice Yegan concurring.
