Disposition notice

The Court of Appeal, Third Appellate District, affirmed the judgment against Derrick Nathan Thompson. Thompson pled no contest to assault with a deadly weapon (Pen. Code, § 245, subd. (a)(1)); the trial court dismissed the remaining charge and a separate case not subject to this appeal, sentenced Thompson to three years in prison in accordance with the plea agreement, imposed a $300 restitution fine (§ 1202.4, subd. (b)), declined to impose any other fines or fees after finding Thompson indigent, and awarded 777 days of custody credit. Before the plea, Thompson filed a motion for mental health diversion (§ 1001.36), which the trial court denied without prejudice after finding he had not made a prima facie showing of suitability. Thompson timely appealed but did not obtain a certificate of probable cause (§ 1237.5). Appointed counsel filed an opening brief under People v. Wende (1979) 25 Cal.3d 436, asking the court to review the record for arguable issues; Thompson was advised of the right to file a supplemental brief, more than 30 days elapsed, and the court received no communication from him. Having undertaken an examination of the entire record, the court found no arguable error that would result in a disposition more favorable to Thompson and affirmed the judgment.
