Disposition notice

On October 23, 2026, Chief Judge Dolly M. Gee of the U.S. District Court for the Central District of California entered a final judgment as to defendant Billy W. Abshier in this SEC enforcement action (No. 2:24-cv-10745). Abshier consented to the judgment without admitting the complaint's allegations, waived findings of fact and any right to appeal. The judgment permanently enjoins him from violating Section 10(b) of the Securities Exchange Act and Rule 10b-5, and, under Exchange Act Sections 21(d)(1) and (d)(5), bars him from participating in the issuance, purchase, offer, or sale of any security, except that he may buy or sell exchange-listed securities for his own personal account. It orders a $236,451 civil penalty under Section 21(d)(3), payable in four installments ($23,646 within 30 days, then three payments of $70,935 due within 120, 240, and 360 days), with post-judgment interest under 28 U.S.C. § 1961 and acceleration of the balance upon default. Payment is secured by a 7.158-acre parcel in Temple, Bell County, Texas, held in a trust of which Carol Sue Abshier is sole trustee. The SEC may propose a Fair Fund distribution under Sarbanes-Oxley Section 308(a), and Abshier may not seek a penalty offset in related investor actions. Solely for purposes of Bankruptcy Code Section 523, the complaint's allegations are deemed admitted and the debt is treated as one for violation of the federal securities laws under Section 523(a)(19). The court retained jurisdiction to enforce the judgment and directed the clerk to enter it forthwith under Rule 54(b).
