Disposition notice

On October 16, 2026, Judge Dale A. Drozd of the U.S. District Court for the Eastern District of California adopted in full the magistrate judge's January 15, 2026 findings and recommendations and dismissed Richard D. Casity's first amended complaint without prejudice, directing the Clerk to close the case. Casity, proceeding pro se and in forma pauperis, had been warned in a November 3, 2025 screening order that his complaint appeared barred by Heck v. Humphrey, 512 U.S. 477 (1994), among other deficiencies, and was given thirty days to amend. The magistrate judge found the December 3, 2025 amended complaint did not cure those deficiencies and recommended dismissal without further leave to amend as futile. Casity filed no objections within the fourteen-day period, and the court conducted de novo review under 28 U.S.C. § 636(b)(1)(C), concluding the findings and recommendations were supported by the record and proper analysis.
